The dueling complaints of Mullica Township Mayor William Kennedy and Mullica Township resident Louis Vitale will go to trial in Folsom Borough court Sept. 15, court officials said Thursday. Vitale has alleged Kennedy assaulted him at a school board meeting in May, while Kennedy claims Vitale harassed him. The matter was referred out of Mullica court because Kennedy’s job presented a conflict of interest.

The case will be heard by Judge Frank Raso. Borough Prosecutor Jim Curcio will prosecute Vitale, and Estell Manor Prosecutor Edward Duffy has been enlisted to prosecute Kennedy. Curcio was deemed ineligible for that role because Kennedy had once voted in favor of appointed Curcio public defender in Mullica. Kennedy faces re-election to Mullica Township Committee in November.
